I love the argument that mediation is a win for them. I mean it is, but not in the way they're hoping and if Percy really is a grifter he won't take it anyways.
For example mediation could decide Vic has to apologize publicly and donate to a charity and attend counseling, vs the judge can basically say "pay legal fees and damages to these people" but can't force an apology
Since the dismissed charges are still dismissed, this is a chance for Percy to try and mediate down to something like his client only has to pay reasonable court fees for the defense parties and to avoid any sanctions/a lengthy and more costly appeals process
But man do the vicstains think this is a win because Marchi is supposed to attend (it doesn't reverse the dismissal of her charges, just she needs to be there since she'll have to go through appeals too if they don't agree to a settlement)
Like it's assumed if you file a SLAPP you can eat the attorney fees. It's all about forcing other side to spend time and money defending themselves. Some cases state the judge limits it to be equal to what was paid in attorney fees. So if Vic is lucky it'll just be double the cost.
duck bastard
: That's where mediation would be a godsend for him. If he takes an offer like "publicly appologize and pay all the defense fees" he's paying only like 1/4 of his potential lowball figure.
Yeah, I don't think Vic will take it and if Percy is what we think he is he will advise Vic not to take it. Percy has a lot to gain from appeals. More GFM money from rabid fans.

: I don't know what their end game is but I wonder if "apologize and pay the fees" would be tempting considering they're under constant harassment and false reporting. It'd be a way to cut down a portion of the crazies out there.
I mean the case isn't hard it's not like Funi is going to lose I just mean drawing this out longer will continue the campaign to discredit. It's not working in the big sense but is annoying.
Funi is in a situation that all corporations go through. Corporations are used to shit-slinging and lies. It's amazing to deal with when you're cashing checks.
Yeah, here's the thing. Vic's target is, effectively, Sony. You know, one of the bigger conglomerate companies on the planet. An Insurance conglomerate, at that.
Honestly I'm not even sure they'd put too much faith in an apology requirement, considering they have to know what his "apologies" are like at this point
Like I'm sure if you go looking for it (I'm on mobile and even trying would make my phone weep) you can find the "apology" video he made for his fans before this lolsuit started
(they like to allege it's a genuine thing that just ~happened~ to be recorded by a fan, but sure that checks out, there's just the one video and it happens to be from a dude in the front row with an unobstructed view of Vic)
Also the running talking point is "Gregg probably altered the transcripts" because that makes sense. The fact it's collaborated by several people having been in the courtroom including a lawyer not connected to the community should be a sign but you know.
considering that the main reason the women in this case came forward was because they wanted to keep the community safe, support victims and and raise awareness of vic's behaviour, i find it hard to believe they'd go for a confidentiality agreement even if one was brought up
Yeah I don't think they'll take that. Especially since Marchi's was a slam dunk and the judge even said she had the strongest case in the room when he told them to mediate. I think that was pressure for Vics side to just give up and beg for mercy.
Dudes, threatening the judge isn't going to save your precious symbol of male victimhood (let's face it, the biggest donators aren't genuine Vic fans but incels latching onto him)
And I remember now: sanctions are inherent in the TCPA. Anti-SLAPP laws as a rule include sanctions as an inducement to make a SLAPP so painful that someone will not file one again.
Yeah, I was gonna say, not sure he can be put on the sex offender registry unless he's actually convicted of something, and this case isn't about anything he did (despite he and his legal team evidently not being clear on that fact)
I did a quick Google search and found cases where people successfully filed to be exempt from bankruptcy treatment because they were owed anti SLAPP fees
they could do something like devolver digital (iirc) did for e3 where they parody/bootleg a bunch of their games. something like that would be super fun.
watching it now; 5 of 10 mins in, he's just discussing where libel/slander even applies (whether it's based on fact or not, whether the person is a celebrity, if it's based on opinion, if it's too ridiculous to be believed, etc)
it's not pro-Vic or anti-Vic, it's just stating that yes, "libel-proof" is in fact a real thing and a valid legal defense that could very well pass muster, and what it means is this, that the person's reputation is already terrible.
he mostly critiques movies for unrealistic courtroom shenanigans and highlights the processes and paperwork that gets ignored in media, so I'm hoping he reviews Vic's legal team and hopefully say he's seen more realistic stuff in ridiculous movies
Also, hbomberguy is a good one, he's both extremely progressive (he ran that DK 60-hour continuous livestream that ended up generating $330k for a charity for trans kids that was talked about a lot back when it happened) and fucking hysterical
actually had that convo at a con last year. me (girl) + about five other girls were sitting around with a mutual friend. someone mentions Vic being a creep and the guy (who works guest relations) was like 'wow, no way, he's always seemed like a really chill guy' and we were just like "....... no, honey"
He apparently was trying to harass someone about being Eren from attack on titan back when that was blowing up, so he definitely seeked out parts that would make him popular
amazingoff color joke made
