my read on it is that Congress was focused on current workforce peoples and not retirees which is why they weren't explicitly listed as protected, regardless of whether they intended to protect them
yeah, it's one of those things that should really be in there already, but it's not shocking it isn't... but generally speaking I can't deny it's appropriate for the court to keep its rulings as narrow as it can in interpreting law as-written, rather than making up some shit about what it ~really~ means.
