I remember the arguments around the Civil Rights Act of 1875 so it immediately made me think this person was arguing they were an Inn / Hotel / whatever other name you want to give it

weirdly a hotel has the right to kick you out for any reason

ok besides the ones protected by law

I mean, that's the case now

But the CRA of 1875 was ruled unconstitutional

which is why that was the one that came to mind specifically

(I think the current one held because we basically made a better argument for why the government has the right to enforce it, but I think the first one was based on the commerce clause for some reason)
