[uspol] okay so I'm mostly over the legal stuff bc at this point it's just stupid and exhausting but I decided to check in just now and man, the latest dumb lawsuit features maybe the dumbest thing yet

the suit is claiming that state legislatures are supposed to have "plenary power" to set election law -- they can do literally whatever they want and no court decisions can enforce any particular interpretation of a state law unless the legislature specifically says so (note: none of this is actually legally true, it is a very fringe interpretation, but w/e)

so SCOPA wasn't allowed to interpret the PA election code the way they did in various issues (they actually didn't do what the suit claims they did, but again, w/e)

...wait, they're saying in the same lawsuit both that the legislature can do anything they want re: elections therefore the state supreme court can't tell the state what to do BUT ALSO that the legislature wasn't allowed to pass a law for mail voting because the legislature doesn't have that power over elections?
